Sometimes what feels right for your family dynamics may not be consistent with the law like this case:
CLIENT QUESTION:
I have two children whom I love equally. Can I appoint them both to be my health care proxy agent to make my medical decisions?
MY RESPONSE:
As most of my readers know, a New York Health Care Proxy is the only legal document in New York that allows you to appoint someone to make your health care decisions for you if and when you can no longer communicate your wishes yourself. I know what you are thinking…”I love my children equally and I do not want to pick one over the other.” Well, my advice to you is to GET OVER IT!
New York law is very clear that it does not want you to pick two people who may end up disagreeing and throwing this whole decision-making situation into court. The law provides that you may only appoint ONE agent at a time. So, if you have two kids, you may pick one as the primary agent and the other as a successor or backup agent. If you pick both at the same time, your health care proxy may very well be void.
