CHANGING A TRUST?

CLIENT QUESTION:

I have had your irrevocable Medicaid trust for over five years now and would like to change the trust. Would my 5-year lookback period be negated, and would a new period start?

MY RESPONSE:

I must give you a lawyer’s answer…IT DEPENDS! We already built into your trust the ability to change trustees and beneficiaries, and these changes will NOT affect your lookback or the overall protection that the trust provides. But other changes might. So, it all depends on what you are trying to change. Just know that we may have the opportunity to change your irrevocable trust, but we will have to examine the pros and cons of our choices.
