Client Alert – NY State Allows Remote Notarization

A MESSAGE TO OUR CLIENTS – SOME GOOD NEWS

NEW YORK STATE ALLOWS REMOTE NOTARIZATION OF ESTATE PLANNING DOCUMENTS IN AN EFFORT TO GET YOUR DOCUMENTS DONE AT HOME!

This pandemic has made many of us aware of the crucial need to BE PREPARED by having the proper estate planning documents in place. Now, New York State is making it even easier to accomplish this objective during this time of crisis without leaving your house.

Governor Cuomo, by Executive Order dated March 19, 2020, has allowed documents to be notarized via remote video conferencing. In other words, we can notarize your documents through our phones and iPads! This is incredibly helpful because you will now be able to easily “sign” vital documents such as powers of attorneys, deeds, trusts or anything else that requires a notary.

There are certain rules in place that must be followed such as, we as your notary, must either know you or at the least, you must show us your photo ID. Just holding up your driver’s license to the phone for us to see should do it! During the video conference, we must both interact live and you must state out loud that you are in New York at the moment.

After signing, any documents that are being notarized have to be sent electronically to us on the very same day that it was signed. All you have to do is take a picture on your phone and forward it to our office. Upon receipt, we will notarize the electronic copy and then send it back to you. It will then be valid immediately. The original can be signed by us within 30 days of the video conference signing.

This new notary law is especially critical right now. People absolutely need these documents and now it can get done from both of our homes.
