CLIENT QUESTION:

Do assets held inside my son’s SNT count toward the amount he is allowed to remain eligible for SSI and MEDICAID?

MY RESPONSE:

NO! This is the purpose of a Special Needs Trust (SNT). If your son is on government benefits that require poverty as a condition of eligibility, then placing assets (either his or yours or another relative or friend) in an SNT for him may be the best thing you can do. The money in the trust will ALL be available to him to enhance and enrich his life without jeopardizing his government benefits. WIN WIN!!!! We write these trusts every day.
