CLIENT QUESTION:

In 2008 your firm created an irrevocable Medicaid trust for me. My question is, is a notarized letter to the trustee sufficient for their removal?

MY RESPONSE:

Trusts can be written in several ways and our forms have evolved over time. The exact process to remove the trustee in your particular trust will be governed by your particular trust. It may very well be that a notarized letter notifying the trustee of their removal is sufficient, but you may also have to prove that they received the notice. Furthermore, you would have to appoint a new trustee, which may require a trust amendment. The best advice is to come in for a consultation to make sure we get it right in your case.
