READER QUESTION:

Our brother lives in a group home run by ACLD. We have a Special Needs Trust (SNT) for his benefit. Should we also have a Qualified Disability Trust (QDT) to help reduce taxes?

MY RESPONSE:

You want another trust? Why does this stuff have to be so complicated?

Luckily, this one is simpler than it looks.

A Qualified Disability Trust (QDT or Q DOT) is not a second trust. Nothing new gets created. It’s just a tax label that certain trusts qualify for…and your brother’s probably already qualifies.

To qualify, the trust has to be irrevocable, for your brother’s sole benefit, and he has to meet the Social Security definition of disability (if he already qualifies for SSI or SSDI he meets the definition).

What does it actually do? It gives the trust a better exemption for income taxes. In 2026, instead of the usual trust exemption of about $100 or $300, the trust gets roughly $4,700 or so.

That helps because trusts hit high tax brackets fast. In 2026, a trust is already in the top 37% bracket once it has a little over $15,000 of taxable income.

Is it a big planning opportunity? Not really. If the trust keeps income inside, you save something. If the money is being used each year for your brother, it doesn’t move the needle much.

This is not about setting something new up. This is about making sure the tax return is being done the right way.

So the answer is no, no second trust. Just make sure what’s already there is being treated properly.
