READER QUESTION:

If there are two grantors on an irrevocable MEDICAID trust, can one of them make changes to trustees or beneficiaries without the other’s consent?

MY RESPONSE:

As a practical matter, NO; they must both agree. However, after the death of the first grantor, the surviving grantor CAN change the trustees and beneficiaries. If this is a problem, we can draft around it.
